New Jersey Workers’ Compensation lawyers examine whether a partnership enjoys the immunity of its partners for a work injury involving workers comp benefits for a work injury inclusive of a permanency award

Plaintiff instituted a third-party negligence action against a number of parties for her work injury including the lessee of the premises, a general partnership in which her employer was a partner. She had been injured at work and received NJ workers' comp benefits from her employer including a permanency award. Arguing that the immunity provided by N.J.S.A. 34:15-8 applied, the partnership sought summary judgment. The partnership contended that it was entitled to share in the immunities provided to those partners because the partnership shared liability for the actions of its agents. The court concluded that under the New Jersey Workers' Compensation Act the partnership was a separate entity, a third-party. Further, the Revised Uniform Partnership Act reflected an evolution in the legal theory of partnerships, adopting the entity theory and rejecting the common-law notion of a partnership being an aggregate of its partners. Pursuant to the express language of both statutes, and the general policies of the Act, the partnership was not entitled to the immunity provided by N.J.S.A. 34:15-8 to its partner, the employer of plaintiff.
